BJP v. West Bengal Govt (Election Case)

In March 2025, the Bharatiya Janata Party (BJP) and its West Bengal leader Suvendu Adhikari filed a writ petition in the Supreme Court against the State of West Bengal. The petition alleged that following the 2024 general elections, ruling Trinamool Congress cadres unleashed a wave of retaliatory violence against BJP workers, including murders, rapes, and arson. The BJP contended that the state police deliberately refused to register FIRs or conduct impartial investigations, creating an atmosphere of terror. It sought a court-monitored CBI probe and compensation for victims. The West Bengal government denied the allegations, asserting the state machinery was acting fairly and accusing the petitioners of maligning the state. The Supreme Court bench examined detailed reports and evidence presented by both sides.

In May 2025, the Supreme Court declined to transfer all cases to the CBI but directed the agency to investigate a limited number of the most heinous incidents, including cases of alleged murder and sexual assault. Other matters were ordered to be investigated by a state-formed Special Investigation Team, monitored by a retired High Court judge. The court severely criticized the state police for lapses and reaffirmed the fundamental right of political workers to live without fear.

The primary dispute was whether the West Bengal government had abrogated its constitutional duty to protect citizens and maintain law and order, justifying the transfer of criminal investigations to an independent central agency and overriding state police autonomy.

The verdict was widely perceived as a judicial indictment of the West Bengal government, deepening the political feud between the ruling Trinamool Congress and the BJP. It set a precedent for judicial oversight in cases of alleged state-sponsored political violence and triggered a nationwide debate on the misuse of state machinery to suppress opposition voices. The BJP leveraged the judgment to intensify its campaign against opposition-ruled states, while civil society groups highlighted the urgent need to de-politicize law enforcement.
