Hall v. Talladega Housing Authority

On March 9, 2026, Jane Hall, an African American single mother and Section 8 voucher holder in Talladega, Alabama, filed suit against the Talladega Housing Authority. Hall challenged the Authority’s blanket policy of automatically terminating rental assistance for any household member with a drug-related criminal record, regardless of rehabilitation or the age of the conviction. Hall had completed a court-ordered treatment program years earlier and maintained steady employment, yet received a termination notice after a routine re-examination. Represented by legal aid attorneys, she alleged that the policy violated the federal Fair Housing Act by creating an unlawful disparate impact on Black and female-headed households, and sought declaratory and injunctive relief to reinstate her voucher and block enforcement of the policy.

The U.S. District Court for the Northern District of Alabama granted a preliminary injunction on March 15, 2026, ordering the Housing Authority to immediately reinstate Hall’s voucher. The court found a substantial likelihood that the categorical ban failed to account for individualized evidence of rehabilitation and lacked a legally sufficient justification for its sweeping exclusionary effect.

The central dispute was whether the Talladega Housing Authority's absolute, no-exceptions criminal record screening policy constituted illegal racial and sex-based discrimination under a disparate impact theory, in violation of the Fair Housing Act, given statistical evidence of disproportionate harm to protected groups.

The case intensified national scrutiny of criminal history screening in federally subsidized housing. It prompted the U.S. Department of Housing and Urban Development to issue revised guidance discouraging blanket bans and encouraging individualized assessments. Civil rights organizations cited the ruling as a critical precedent for limiting housing barriers faced by formerly incarcerated individuals, particularly women of color.
