Tian and Shi Adultery Case

During the early Western Han period, a man named Tian and a woman named Shi engaged in consensual illicit intercourse (hejian). They were seized by captors, but the captors failed to perform the required on-site formalities of binding the offenders and verifying the act (an zhi jiao shang). The case was escalated to the central judiciary. The core issue was whether this procedural lapse invalidated the charge of adultery. Some legal officials argued that without immediate on-site verification, a conviction could not be secured. The court, however, ruled that the substantive act of illicit intercourse had been proven, and the procedural requirement for captors did not constitute an absolute precondition for conviction. Tian and Shi were consequently found guilty and sentenced to the standard punishment for hejian, likely being made bond servants (nai wei li chen qie). This case became a significant reference for Han legal procedure concerning sex crimes.

The court (ting) held that Tian and Shi were guilty of hejian despite the captors' failure to perform on-site verification. The judgment affirmed that evidence of the illicit act itself was sufficient, and procedural omission did not bar conviction. The offenders were sentenced to the prescribed punishment for adultery.
