The Case of Prison Officer Lan Fornicating with the Hidden Woman Nan

In the early Han Dynasty, Prison Officer Lan, while exercising his law enforcement duties, encountered Woman Nan, who was hiding from authorities as a fugitive from the State of Zhao. Instead of arresting her, Lan forcibly had sexual intercourse with Nan and continued to conceal her. The local Jiangling authorities discovered the misconduct and submitted the case to higher judicial officials, including the Commandant of Jiangling and the Chief Prosecutor, for legal deliberation on how to punish Lan for both the sexual violation and the breach of official duty in protecting a fugitive.

After extensive deliberation among legal officials, Lan was convicted of aggravated sexual misconduct and dereliction of duty. The final sentence was *Wanchengdan* (完为城旦), a severe punishment of forced hard labor without bodily mutilation, which stripped him of his office and subjected him to years of penal servitude building city walls. Woman Nan received a reduced punishment due to the duress she suffered.

The central dispute was how to categorize Lan's sexual act—whether it constituted rape by force or consensual fornication given the circumstances of concealment—and how to weigh his aggravated liability as a public officer. Additionally, the legal treatment of the hidden woman Nan as both victim and fugitive posed a question about her own culpability under Han statutes.

This case, preserved in the Zhangjiashan Han bamboo slip legal collection *Zouyanshu*, demonstrated the early Han dynasty's commitment to holding law enforcement officers accountable for sexual crimes and corruption. It reinforced the principle that officials abusing their power to exploit vulnerable individuals would face stern, exemplary punishments, thereby promoting public trust in the impartiality of the judicial system.
