Trident Real Estate Development, LLC v. The Southern District of the Lutheran Church-Missouri Synod

A real estate developer, Trident Real Estate Development, LLC, sued the Southern District of the Lutheran Church-Missouri Synod after the church refused to remove a perpetual restrictive covenant on a 15-acre parcel it had sold in 1952. The covenant prohibited any use contrary to Lutheran doctrine. Trident planned a mixed-use project including a casino and liquor stores, which the church deemed a violation. Trident argued the covenant was an unreasonable restraint on alienation and violated public policy. The church invoked its First Amendment rights and the Religious Land Use and Institutionalized Persons Act. The case was filed in federal district court in Georgia and drew national attention from religious liberty advocates and real estate groups.

The U.S. District Court for the Northern District of Georgia granted summary judgment in favor of the Southern District of the Lutheran Church-Missouri Synod. The court held that enforcing the covenant was protected under the First Amendment’s church autonomy doctrine and did not constitute state action. It also ruled that the Religious Land Use and Institutionalized Persons Act supported the church’s right to apply its doctrinal standards to land it once owned, and that the covenant was not void for public policy given the strong interest in religious freedom.
